Health Professionals Services Program (HPSP) Attorney Representation
We advise physicians and other health care professionals about participation in the Health Professionals Services Program (HPSP). Health care professionals who may be unable to practice with reasonable skill and safety due to an illness or use of alcohol or drugs may be referred by their professional licensing board to the Health Professionals Services Program (HPSP). Health care professionals may also self-report to HPSP.
The mission of HPSP is to protect the public by providing monitoring services to licensed professionals whose illnesses or use of alcohol or drugs may impact their ability to practice safely. HPSP enters into program participation agreements with individual licensees. These agreements may be quite robust and include random drug screening, ongoing support group participation, practice monitoring, health monitoring, practice restrictions, and ongoing reporting by the licensee and their employer, among other things. HPSP may refer enrollees to health care professionals for evaluation and treatment. HPSP program participation requirements may be stringent and extend for several years. A licensee completes HPSP when the terms of their program participation agreement are fulfilled. HPSP may terminate an enrollee’s participation and report to their occupational licensing board if they violate their participation agreement.
It is important for health care professionals to understand their rights and responsibilities before enrolling in HPSP or if encountering a challenge while enrolled in HPSP.
We can provide legal advice to health care professionals who have questions and:
Are considering self-reporting to HPSP
Have been referred to HPSP by their licensing board
Are enrolled in HPSP and have suffered a lapse or are experiencing program participation challenges
